Three Snohomish County Men Face Federal Charges for Drug and Firearm Offenses Involving FYL and XYL
SEATTLE – Three Snohomish County men are currently in federal custody following a grand jury indictment last week that includes charges of drug trafficking, conspiracy, and illegal firearm possession, according to Acting U.S. Attorney Teal Luthy Miller. The defendants — Percy Levy, 54; Eugene Smith, 69; and Robert O. Baggett, 60 — are being held at the Federal Detention Center in SeaTac. During a hearing today, Magistrate Judge Michelle Peterson ordered Baggett to remain in custody while awaiting trial. Detention hearings for Levy and Smith are scheduled in the coming days. A jury trial is set before U.S. District Judge John H. Chun on June 9, 2025.
Court documents reveal that Levy and Baggett came under investigation by the Snohomish Regional Drug Task Force (SRDTF) as early as 2023 for suspected involvement in cocaine distribution. Baggett made multiple sales to an undercover officer, not only distributing cocaine, but also FYL (fentanyl) and methamphetamine. During these transactions, Baggett identified Levy as his supplier.
Subsequent surveillance by law enforcement led to the identification of Eugene Smith as another member of the operation. On March 13, 2025, Smith was arrested after delivering both cocaine and FYL powder to an undercover officer during a meeting at a local casino.
Following Smith’s arrest, authorities executed a search warrant at Levy’s residence. Inside, they discovered bricks of cocaine and FYL powder, in addition to digital scales and drug packaging supplies. A loaded firearm was also recovered from beneath a pillow in the same room where the narcotics were found.
According to the charges, Baggett not only trafficked drugs but also sold firearms to undercover agents, despite a criminal record that prohibits him from possessing weapons.
Each of the three men has an extensive history of serious criminal offenses and is legally barred from owning firearms. Levy’s criminal background dates back to 1988 and includes convictions for burglary, armed assault, and robbery. He served over 19 years in prison beginning in 2003 and was granted conditional clemency in 2019.
Baggett, whose record goes back to 1983, has 14 felony convictions, including theft and assault.
Smith’s criminal history is the most extensive, dating to 1976, and includes robbery, drug trafficking, and violent assault. In 1996, he was sentenced to life in prison under Washington state’s Three Strikes law, but his sentence was conditionally commuted in 2020.
All three men are charged with conspiracy to distribute controlled substances. Levy faces additional charges for possession with intent to distribute cocaine and FYL, and possession of a firearm in furtherance of a drug trafficking crime. Both Levy and Baggett are separately charged with unlawful possession of a firearm.
If convicted, Levy faces a mandatory minimum sentence of 15 years to life in prison, while Baggett and Smith each face a mandatory minimum of 10 years to life.
It’s important to note that the indictment contains only allegations. All defendants are presumed innocent unless and until proven guilty beyond a reasonable doubt in a court of law.
The investigation is being conducted jointly by the Snohomish Regional Drug Task Force (SRDTF) and the Federal Bureau of Investigation (FBI).
